The Website is operated by Skies No Limit, ABN 69 733 113 704. Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of its Services, immediately.

Skies No Limit reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes to the Terms take immediate effect from the date of their publication. We recommend you keep a copy of the Terms for your records.

You accept the Terms by remaining on the Website or submitting any form, including the AI & Automation Audit questionnaire or Secure Credential Submission Portal. Where the option is available in the user interface, you may also accept the Terms by clicking to accept or agree to the Terms.

2. About the Services

Skies No Limit provides the following services through its websites:

• AI & Automation Audit (audit.skiesnolimit.com.au): A web-based audit questionnaire that analyses your trade business operations and generates a customised AI and automation recommendations report.
• Secure Credential Submission Portal (credentials.skiesnolimit.com.au): A secure form allowing clients to submit platform login credentials, API keys, and access details required for automation implementation.
• AI Consultancy & Implementation Services: Ongoing automation strategy, workflow design, and system implementation services delivered to trade businesses.

These Services are provided on a project or engagement basis as agreed between Skies No Limit and the client. No ongoing subscription or account registration is currently required to access the audit or credential portal.

3. Acceptable Use of the Services

All Services, related features, and websites must only be used lawfully. Skies No Limit reserves the right to suspend, cancel, or otherwise deny access to any user who uses the Services:

• To engage in any act that would disrupt the access, availability, or security of any Skies No Limit service, including tampering with, reverse-engineering, or hacking our servers
• To modify, disable, or compromise the performance of any Skies No Limit service
• To overwhelm our infrastructure by imposing an unreasonably large load on our systems
• To compromise the integrity of our systems, including probing, scanning, or testing vulnerabilities without express written permission
• For any illegal purpose, or to violate any applicable laws including data, privacy, and export control laws
• To misrepresent or defraud any user or member of the public through phishing, spoofing, impersonation, or falsely implying association with Skies No Limit
• To submit false, misleading, or fraudulent information through any form or portal
• To submit credentials for platforms or systems you are not authorised to share access to
• In any way that violates the intellectual property rights of Skies No Limit or any third party

4. Credential Submission

By submitting credentials through credentials.skiesnolimit.com.au, you acknowledge and agree that:

• You are authorised to share the credentials submitted and have the legal right to grant access to the platforms specified
• Credentials will be used solely for the agreed automation implementation scope
• Credentials will be stored securely with AES-256 encryption and access restricted to authorised Skies No Limit personnel only
• All credentials will be deleted upon completion of your implementation or upon written request
• Skies No Limit will not be liable for issues arising from inaccurate or unauthorised credentials submitted by you
• You are responsible for disabling or revoking access after implementation is complete if you choose to do so

5. Security and Data Privacy

Information provided through your use of the Website and/or Services is subject to Skies No Limit's Privacy Policy, available at skiesnolimit.com.au/privacy-policy.

Skies No Limit implements industry-standard security measures including AES-256 encryption, TLS connections, two-factor authentication, and restricted access controls. However, no method of transmission over the internet is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

6. Fees and Payments

Skies No Limit's AI & Automation Audit is currently provided at no cost. Consultancy, implementation, and automation services are quoted and agreed separately on a project basis.

Where fees apply, payment terms will be outlined in a separate engagement agreement or proposal. Payments may be processed via third-party payment platforms. Skies No Limit will not be liable for any losses arising from the operations of third-party payment processors.

Where a payment is returned or denied for any reason, you remain liable for any associated banking fees and charges.

7. Refund Policy

Skies No Limit operates in accordance with the Australian Consumer Law. Where a paid engagement is involved, refunds will be considered on a case-by-case basis at the discretion of Skies No Limit, having regard to the proportion of work completed at the time of the request. The free audit tool is provided without charge and no refund obligations apply.

8. Copyright and Intellectual Property

The Website, Services, audit tools, reports, methodologies, automation frameworks, and all related materials are subject to copyright under the laws of Australia and international treaties. All rights are owned by or licensed to Skies No Limit.

You are granted a non-exclusive, non-transferable, revocable licence to use the Website and Services for your own internal business purposes. This licence does not permit you to:

• Reproduce, republish, distribute, or resell any audit reports, frameworks, or materials produced by Skies No Limit
• Reverse-engineer or replicate any tool, workflow, or system developed by Skies No Limit
• Use any Skies No Limit materials for commercial purposes without prior written consent

Skies No Limit retains all rights, title, and interest in all Services, tools, methodologies, and deliverables, including audit reports and automation roadmaps, unless otherwise agreed in writing.

9. General Disclaimer

Nothing in these Terms limits or excludes any guarantees or rights implied by the Australian Consumer Law that cannot be excluded by law.

To the extent permitted by law, Skies No Limit will not be liable for any special, indirect, or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms.

10. Limitation of Liability

To the extent permitted by law, Skies No Limit's total liability arising out of or in connection with the Services or these Terms will not exceed the total fees paid by you to Skies No Limit in the 3 months preceding the claim, or $100 AUD where no fees have been paid (e.g. free audit users).

11. Termination

These Terms continue to apply until terminated. You may cease use of the Services at any time. Skies No Limit may terminate your access to Services immediately if you breach any provision of these Terms, if continued service is no longer commercially viable, or if required to do so by law.

12. Indemnity

You agree to indemnify Skies No Limit, its employees, agents, and contractors from and against all claims, damages, losses, and costs (including legal fees) arising from your use of the Services, breach of these Terms, or submission of false, unauthorised, or misleading information through any Skies No Limit portal.

13. Dispute Resolution

If a dispute arises, the parties must first attempt to resolve it in good faith by written notice detailing the nature of the dispute. If unresolved within 28 days of notice, the parties agree to pursue mediation before commencing any court proceedings. Mediation will be conducted in Queensland, Australia, or via a mutually agreed remote format.

All communications concerning negotiations made by the parties arising out of and in connection with this dispute resolution clause are confidential and must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

14. Venue and Jurisdiction

These Services are intended for residents of Australia. Skies No Limit operates across Queensland, New South Wales, Victoria, and South Australia. Any dispute arising out of or in relation to these Terms shall be resolved exclusively in the courts of Queensland, Australia, or such other Australian court of competent jurisdiction.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia. All disputes shall be interpreted and construed under the laws of Queensland without reference to conflict of law principles. Nothing in these Terms limits your rights under the Australian Consumer Law, which applies nationally.

16. Severance

If any part of these Terms is found to be void or unenforceable by a court of competent jurisdiction, that part shall be severed and the remainder of the Terms shall continue in full force.
